These Mobile Messaging Terms of Service govern your participation in the SMS marketing and informational program (the “Program”) operated by LUV2BRD (“we,” “us,” or “our”). By opting into or participating in any of our Programs, you accept and agree to these terms and conditions.
1. Program Details and Consent
By subscribing to the LUV2BRD mobile messaging Program, you expressly consent to receive recurring automated promotional and personalized marketing text messages (e.g., SMS and MMS), including cart reminders, that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number you designate.
- Program Name: LUV2BRD Alerts and Promos
- Message Type: Promotional, marketing, and transactional (e.g., order updates, cart reminders).
- Message Frequency: Message frequency will vary. You can expect to receive up to 2 messages per month.
- Cost Disclosure: Message and data rates may apply. All charges are billed by and payable to your mobile service provider. We do not charge for the service itself.
- Non-Condition of Purchase: You understand and agree that consent to receive automated marketing text messages is not a condition of any purchase of goods or services from LUV2BRD.
2. User Opt-Out and Cancellation
You can cancel the SMS service at any time.
- Opt-Out Method: Text the keyword STOP, CANCEL, or UNSUBSCRIBE to the phone number from which you received the message to cancel.
- Confirmation: After texting STOP, you will receive one additional message confirming that your request has been successfully processed.
- Other Opt-Outs: You acknowledge that our mobile message platform may not recognize and respond to unsubscribe requests that do not include the designated keyword commands and agree that LUV2BRD and its service providers will have no liability for failing to honor such requests.
3. Help and Customer Care
For support regarding the Program or if you are experiencing any problems:
- Help Keyword: Text the keyword HELP to the phone number from which you received the message.

4. Warranty, Liability, and Carriers
- Service Availability: The Program is offered on an "as-is" basis and may not be available in all areas at all times. Not all mobile devices or handsets may be supported, and our messages may not be deliverable in all areas.
- Liability: LUV2BRD, its service providers, and the mobile carriers supported by the Program are not liable for delayed or undelivered messages.
- Supported Carriers: The Program is supported by all major mobile carriers including, but not limited to: AT&T, Verizon Wireless, T-Mobile, MetroPCS, U.S. Cellular, Sprint, and others.
5. Privacy
We respect your privacy. By participating in the Program, you acknowledge and agree to our Privacy Policy, which is available at https://luv2brd.com/policies/privacy-policy.
- Data Usage: Your Mobile Information (phone number, consent status, message content) will be used to operate, analyze, and improve the Program.
- Exclusion from Sale: We will not sell, rent, or lease your Mobile Information to unaffiliated third parties for their independent marketing purposes.
6. Dispute Resolution (Mandatory Arbitration)
Any dispute or claim arising out of or relating in any way to the Program, these Mobile Terms, or any services provided by LUV2BRD shall be resolved by binding, individual-only arbitration, rather than in court.
- Waiver of Jury Trial: You and LUV2BRD waive any right to a jury trial, or to participate in a class action or other representative action or proceeding.
- Governing Law: This agreement is governed by the laws of the State of California, without regard to its conflict of law principles.
7. Changes to the MToS
We reserve the right to change these Mobile Terms from time to time. Any updates or changes to this Agreement shall be communicated to you by reasonable means, including by posting the revised Mobile Terms on our website and/or sending you a text notification. You acknowledge your responsibility to review these Mobile Terms from time to time. By continuing to participate in the Program after any such changes, you accept the Mobile Terms as modified.
